Welcome to Tiny Troops (the "Game"), a browser game available at tinytroops.io (the "Site"). The Game and Site are operated by the owner of tinytroops.io ("we," "us," "our," or the "Operator"). These Terms of Service ("Terms") are a binding agreement between you and the Operator.
By accessing or playing the Game, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
The Game is intended for general audiences. If you are under the age of majority where you live, you may use the Site only with the consent of a parent or legal guardian who agrees to these Terms on your behalf. If you are a parent or guardian permitting a minor to play, you accept these Terms for that minor and are responsible for their use of the Site.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and play the Game in your web browser for private, non-commercial entertainment. All rights not expressly granted are reserved.

The Game includes fictional items such as coins, skins, boosts, scores, and achievements ("Virtual Items"). Virtual Items:
The Game currently offers no purchases and processes no payments.
The Game, including its code, artwork, design, audio, names, and branding, is owned by the Operator and protected by copyright and other intellectual-property laws. If you send us feedback or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation.
The Game contains flashing lights, rapid motion, and visual effects. A small percentage of people may experience seizures or discomfort when exposed to certain light patterns. If you or anyone in your family has an epileptic condition or has had seizures, consult a doctor before playing. Stop playing immediately if you experience dizziness, altered vision, eye or muscle twitches, disorientation, or convulsions.
We may modify, suspend, or discontinue the Game or Site, in whole or in part, at any time without notice. We do not promise that the Site will be available, uninterrupted, secure, or error-free.
The Site and Game are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including without limitation implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement. We do not warrant that the Site will meet your requirements or that defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
To the maximum extent permitted by applicable law: (a) in no event will the Operator be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or device damage, arising out of or related to your use of (or inability to use) the Site or Game, even if advised of the possibility of such damages; and (b) the Operator's total aggregate liability for all claims relating to the Site or Game will not exceed fifty U.S. dollars (US $50) or the amount you paid us in the twelve months before the claim arose, whichever is greater. Because the Game is free, that amount will ordinarily be US $50.
Some jurisdictions, including certain U.S. states and countries in the European Economic Area, do not allow the limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Operator from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your misuse of the Site.
We may suspend or terminate your access to the Site at any time, with or without cause or notice. Sections of these Terms that by their nature should survive termination (including Sections 5, 8, 9, 10, 12, and 13) will survive.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except that Section 12 is governed by the Federal Arbitration Act. If you reside outside the United States, you may have additional rights under the mandatory consumer-protection laws of your country of residence; nothing in these Terms limits those non-waivable rights.
If you believe content on the Site infringes your copyright, send a notice compliant with 17 U.S.C. § 512(c)(3) to contact@tinytroops.io including: identification of the work, the allegedly infringing material and its location, your contact information, a good-faith statement, a statement of accuracy under penalty of perjury, and your physical or electronic signature.
You may not use the Site if you are located in a country or territory subject to comprehensive U.S. sanctions or are on any U.S. government restricted-party list.
We may update these Terms from time to time. The "Effective date" above shows the latest revision. Material changes take effect when posted to this page; your continued use of the Site after changes are posted constitutes acceptance.
These Terms and the Privacy Policy are the entire agreement between you and the Operator regarding the Site. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a transfer of the Site.
